Being You — Terms of Service

Operator: Being You (BeU), United Kingdom
Product: Being You social and professional networking service (web, desktop, mobile)
Status: Draft for solicitor review — not legal advice and not in force until counsel signs off
Governing law (intended): England and Wales
Last updated: 2026-09-05

1. Acceptance

By creating an account or using Being You you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and regional access

Being You is offered primarily to users outside blocked regions. We may refuse or terminate access where eligibility checks fail.

2.1 Minimum age — 16

You must be at least 16 years old to hold an account. We do not create accounts for under-16s, and we close any we find. There is no parental-consent route around this: under 16 the answer is no.

This is a deliberate product decision, not only a legal one. Childhood should be spent on fresh air, real games and real people — not on an online platform. Nothing beats the real thing, and we would rather lose the signup.

Where local law sets a higher digital-consent age than 16, that higher age applies.

Exact product message (under-age block):

You need to be 16 or over to use Being You. Go and enjoy being a kid — fresh air, real games, real people. Nothing beats the real thing. We'll be here when you're older.

2.2 European Union (residence)

Users whose signup or billing country is an EU member state are denied service. The United Kingdom is not in the EU and is not treated as EU under this policy, nor are any other non-member states.

Exact product message (EU block):

Freedom over censorship, freedom over dictatorship. Democracy first! The United Kingdom is not in the EU: we voted to leave and took our freedom back. Tell your government you want to do the same. People power.

2.3 Argentina (residence and nationality)

Users whose signup or billing country is Argentina, and users who declare Argentine nationality (regardless of current residence, unless counsel narrows this rule), are denied service.

Exact product message (Argentina block):

We are blocking access due to your government's hostility over the Falkland Islands. The islanders want to remain British, so the Islands remain British. If you attempt to circumvent this restriction, your account may be suspended. Any balances are handled under UK law and our Terms — refunded or held only through a lawful process. We do not confiscate funds as a political sanction.

2.4 Circumvention

Using VPNs, proxies, or false declarations to bypass access rules may result in suspension. Suspension is not a licence to seize funds (see §5).

3. Accounts and dual profiles

One account may include a personal profile and a professional profile. You are responsible for safeguarding credentials and for activity under your account. You must provide accurate country and nationality information when asked.

4. Content and acceptable use

  • Content must be law-abiding. Do not post or transmit illegal material under applicable UK law (and any other law that lawfully applies to you).
  • Do not harass, stalk, defraud, or attempt unauthorised access to systems or others' accounts.
  • Do not upload malware or scrape the service in ways that harm availability or other users.
  • Moderation aims to enforce law and these Terms — not opaque political censorship as a product goal. Decisions that remove or restrict content will be grounded in policy or law where practicable.

You retain ownership of content you create. You grant Being You a limited licence to host, display, back up, and transmit that content as needed to operate the service and comply with law.

5. Money, wallets, and refunds — not confiscation

The platform must not seize, confiscate, or permanently withhold user funds as a political sanction, regional penalty, or discretionary punishment.

When an account is suspended, regionally ineligible, or otherwise closed with a positive balance:

  • Eligible funds are refunded or returned via payout where KYC and payment-provider rules allow; or
  • Funds may be placed under a lawful hold only where UK law, AML/tax rules, or a valid court/regulator order requires it.

Prohibited: forfeiture of wallet balance because of EU/AR access policy, VPN use, or nationality; “retain until you relocate / politics change”; any discretionary confiscation tied to access gates.

Fees for services already rendered may be non-refundable; that is distinct from seizing unused balance. Escrow and milestone releases follow contract rules; if parties become ineligible, refund or counsel-approved disposition applies — not platform confiscation.

6. Advertising and commercial surfaces

Personal profiles and personal feeds are ad-free. Optional paid promotion and professional tools apply on professional surfaces only. Marketplace, jobs, and freelance features (when live) have additional product terms as published in-product.

7. Privacy and personal data

We do not sell personal data. Our practices are described in the Privacy Policy. Being You is funded by subscriptions, professional tools, and optional paid promotion — not by selling you as the product.

8. Disclaimers and liability

The service is provided on an “as available” basis. To the fullest extent permitted by UK consumer and commercial law, we exclude liability for indirect or consequential loss. Nothing in these Terms excludes liability that cannot lawfully be excluded (including for death or personal injury caused by negligence, or fraud).

9. Changes and termination

We may update these Terms with notice where required. We may suspend or terminate accounts for breach, ineligibility, or legal obligation. You may stop using the service at any time; money disposition follows §5.

10. Contact

Pre-launch product contact: Being You product team (details to be published at launch).

External gate

Solicitor review is required before launch. These Terms, the Privacy Policy, payment/refund wording, and regional access messages must be reviewed and approved by qualified UK counsel. Until that sign-off:

  • This document is a product draft only
  • It must not be presented as live contractual terms to end users
  • Engineering must not treat this file as a substitute for counsel-approved ToS
